Duncan Forrester is Kate's attorney in "Eggtown" portrayed by Shawn Doyle.
In a flashforward, Duncan escorts Kate to a courthouse. Kate is hesitant about entering and asks if there is a back enterance. Duncan instead tells her that she will go in the front door with her head held high. They then both exit the car and they enter through a throng of reporters and protesters, with Duncan refusing to give any comments.
In the courtroom, despite Duncan's best efforts, Kate is put into custody after she pleads not guilty. Duncan apologizes for her being put into custody, but it is above his power. He later visits her, telling her that the case will need to be a character case instead of about what Kate did or did not do.
After admittedly being damaged in the prosecution's opening statement, Duncan calls a clean-shaven Dr. Jack Shephard to the stand as a character witness. Kate seems visibly shocked. Once sworn in, Jack states that he knows Kate because he was also on Oceanic Flight 815 which crashed on an island in the South Pacific. Duncan then asks him if he knew of Kate's fugitive status and how. Jack replies that it wasn't via the marshal telling him, as he died during the plane crash. It was Kate who later told him of her status.
Duncan then escorts in Kate's mother, and gives them some time alone, which ends in Kate angrily telling her mother she won't be able to see Aaron.
During the courts recess, Duncan, Kate, and Melissa Dunbrook, the DA, discuss sentencing. After rebutting options of four years, Duncan also rebuts ten years probation. However, Kate contradicts him and says she'll take it. ("Eggtown")
Trivia
- During casting this character was known as "Marc Forrester". He was described as a nice looking, cocky, not-afraid-to-argue corporate player willing to risk his position for a promotion in a company buy-out. His boss was supposed to be Arthur Galzethron.
- Forrester shares a name with Duncan B. Forrester, author of Apocalypse Now?: Reflections on Faith in a Time of Terror.
